[NARRATIVE #1 on August 30, 2024]

On August 30, 2024 at approximately 1747 hours, Deputy Spivey and Deputy Vazquez were dispatched to Cranbrake Way and W Nance Springs Rd in reference to a four-wheeler crash. The Whitfield County Communication Center, advised the deputies that were responding to the crash that the four-wheeler was flipped over with the driver pinned underneath it. The deputies were then advised that the male was turning blue and that the caller was attempting to raise the four-wheeler off of him.

When Deputy Spivey and Deputy Vazquez arrived on scene the four-wheeler was facing right side up and a male later to be identified as Stoney Timmons, was lying on his back with the Whitfield County Fire Department providing medical care.

While the fire department was providing medical care to Mr. Timmons, Deputy Spivey asked [WITNESS #1], what happened. Ms. [WITNESS #1] stated she did not know.

An off-duty firefighter, [REDACTED], who works at Whitfield County Fire Station 3, was the first, first responder on scene and advised he could smell an odor of an alcoholic beverage omitting from Mr. Timmons. Mr. [REDACTED] would later state that Mr. Timmons smelled like he came straight from a brewery.

It was approximately five minutes before Deputy Spivey and Deputy Vazquez knew there was another passenger on the four-wheeler. Deputies were only aware of the other passenger when a firefighter asked Ms. [WITNESS #1] if anyone else was riding with Mr. Timmons. Ms. [WITNESS #1] stated yes, her grandson, Juvenile 1, was riding on the back of the four-wheeler. Ms. [WITNESS #1] stated Juvenile 1 was in her car and that he had a few scratches.

Ms. [WITNESS #1] and the deputies went to check on Juvenile 1. Juvenile 1 was crying and had visible scratches on his left elbow. Deputy Spivey asked Juvenile 1 what happened. Juvenile 1 stated that Mr. Timmons was riding the four-wheeler and he hit the gas (throttle) making the four-wheeler go on two feet (wheels) causing it to flip. Juvenile 1 also stated that they were riding on the road, Cranbrake Way (a private drive).

Deputy Spivey then asked Ms. [WITNESS #1], if her husband, Mr. Timmons was drinking earlier. Ms. [WITNESS #1] stated that Mr. Timmons drank two or three beers earlier.

Deputy Spivey was able to talk to Mr. Timmons in the ambulance before he was transported to Erlanger. Deputy Spivey asked Mr. Timmons if he had anything to drink today. Mr. Timmons stated, “oh yes” Deputy Spivey then asked Mr. Timmons how many drinks did he have. Mr. Timmons statement was muffled and unclear. Deputy Spivey asked Mr. Timmons if he would blow into an intoximeter but he refused.

Deputy Spivey then read Mr. Timmons the Georgia Implied Consent Notice. Mr. Timmons stated he would do a blood test because “he had to.” Deputy Spivey explained to Mr. Timmons that he did not have to, but Mr. Timmons stated again that he had to.

Mr. Timmons was then transported by EMS to Erlanger of Chattanooga, TN and Juvenile 1 was transported by EMS to TC Thompson Children’s Hospital to have his injuries evaluated. Due to Mr. Timmons being transported across state lines for treatment, a blood draw was not collected.

Deputy Spivey will be seeking a warrant for Mr. Timmons for O.C.G.A. 40-6-391 (a)(1) D.U.I. less safe due to Mr. Timmons admitting to drinking multiple alcoholic beverages before driving the four-wheeler and the odor of an alcoholic beverage omitting from Mr. Timmons. Deputy Spivey will also be seeking a warrant for O.C.G.A. 40-6-391(l) D.U.I child endangerment due to Juvenile 1, riding on the rear of the four-wheeler when Mr. Timmons crashed.

[NARRATIVE #2 on September 01, 2024]

On September 1, 2024 at approximately 1112 hours, Deputy Spivey Facetimed Magistrate Court Judge, Judge Gazaway, in reference to Whitfield County Case Number 2024-05004. Judge Gazaway issued a criminal warrant for Stoney Timmons for D.U.I. less safe and D.U.I child endangerment.

[NARRATIVE #3 on July 17, 2026]

On July 17, at approximately 0450 hours, Deputy Painter was sitting stationary in the area of South Dixie Highway and West Nance Springs Road observing traffic. During this time, Deputy Painter observed a blue Dodge Ram (Georgia Registration Number [REDACTED]) traveling on West Nance Springs Road towards South Dixie Highway.

Deputy Painter observed the Ram did not have a working driver side headlight. After observing the Ram turn southbound onto South Dixie Highway, Deputy Painter pulled onto the roadway behind it. Deputy Painter initiated a traffic stop on the Ram in the area of South Dixie Highway and East Nance Springs Road using his emergency blue lights.

Deputy Painter made contact on the driver side of the vehicle with the driver, and only occupant, Mr. Stoney Timmons. Upon checking Mr. Timmons through the National Crime Information Center (NCIC) database, Deputy Painter discovered he had an active criminal warrant through Whitfield County. Deputy Painter confirmed with the Whitfield County Communications Center that Mr. Timmons warrant was active and valid. Deputy Painter then requested Mr. Timmons exit his vehicle, to which he complied.

Deputy Painter then placed Mr. Timmons under arrest by placing him in handcuffs behind his back. The handcuffs were checked for fit and double locked. Deputy Painter allowed Mr. Timmons to contact his wife, [WITNESS #1], to come retrieve his truck. Deputy Painter conducted a search of Mr. Timmons incident to arrest, and then placed him in the rear seat of Deputy Painter’s patrol car.

Mrs. [WITNESS #1] arrived on scene after a brief time. Deputy Painter verified that Mrs. [WITNESS #1] had a valid license and turned the truck over to her without incident.

Deputy Painter transported Mr. [TIMMONS] to the Whitfield County Detention Center where he was turned over to intake staff without incident. Deputy Painter served Mr. [TIMMONS] with warrant number W24-1331 (case number 2024-946638WM – charges of O.C.G.A. 40-6-391(a)(1) DUI Alcohol and O.C.G.A. 40-6-391(1) Endangering child by driving under the influence).

This case is considered cleared by arrest through the Whitfield County Sheriff’s Office.
