Officer’s Narrative:

I responded to [600 BLOCK] 4th ave in reference to a disturbance. Dispatch advised that there was a male in a silver Nissan Xterra hitting things with his vehicle. Before I arrived, dispatch advised that the male was now parked by the mailboxes.
Upon my arrival, I observed that the mailboxes at [600 BLOCK] 4th ave had been struck and were on the ground. I asked the individuals in the area what had happened, and they pointed toward the mailboxes at [600 BLOCK] 4th ave, stating that the vehicle parked in front of them had crashed into the mailboxes at [600 BLOCK] 4th ave and damaged them. I drove toward that location and observed the vehicle parked by the mailboxes at [600 BLOCK] 4th ave.
When I exited my patrol vehicle, I observed two males arguing beside the vehicle, which was a gray Nissan Xterra. I asked what was going on. One of the males, later identified as [WITNESS #1], approached me and handed me the keys to the vehicle. [WITNESS #1] explained that he had taken the keys from the other male, later identified as Wilder Olivio Perez Perez.
[WITNESS #1] explained that Wilder was drunk and had been driving recklessly in the parking lot of the apartment complex, where children and other people were walking in the area. [WITNESS #1] explained that when Wilder exited his vehicle to get his mail, he went to the vehicle and removed the keys from the ignition to prevent Wilder from driving away again. [WITNESS #1] stated that Wilder became upset because he had taken his keys and started arguing with him, which is when I arrived on scene.
I spoke with Wilder. Wilder had bloodshot and watery eyes. His speech was slurred, and he was having difficulty maintaining his balance. I asked Wilder to explain what was going on. Wilder stated that he was upset because they had taken the keys to his vehicle. I asked Wilder if he had crashed into the mailboxes at [600 BLOCK] 4th ave, and he stated that he had not. I asked Wilder if he had been driving recklessly in the parking lot, and he stated that he had not. Wilder said that he had just returned from work and was getting his mail.
I asked Wilder if he had consumed any alcohol. Wilder stated that he had consumed a six pack of beer at work. I asked Wilder if he had driven from work to the apartment complex, and he stated that he had. I asked Wilder where he worked, and he stated that his job was near the Dalton DMV location. I asked Wilder for his driver’s license, and he provided a Guatemalan identification card. I later learned that Wilder does not possess a valid driver’s license in the United States.
I spoke with another witness, who had recorded the incident after Wilder struck the mailboxes at [600 BLOCK] 4th ave. The witness identified himself as [WITNESS #2]. [WITNESS #2] explained that he started recording after they heard a loud noise coming from [600 BLOCK] 4th ave. [WITNESS #2] stated that they believed Wilder had struck a vehicle and decided to record him. [WITNESS #2] also stated that this was not the first time Wilder had driven drunk in the area. I uploaded the video to this report. I briefly reviewed the video and observed the vehicle being driven recklessly and Wilder exiting the driver’s seat.
Once Officer Cook (534) arrived on scene, I decided to have Wilder perform Standardized Field Sobriety Tests. The SFSTS were conducted in Spanish, as Wilder does not speak English.
The first test I explained was the Horizontal Gaze Nystagmus Test. I asked Wilder if he had any questions. Wilder stated that he did not. I asked Wilder if he understood what I had explained, and he stated that he did. During this test, Wilder showed the following results:
Lack of smooth pursuit (left eye)
Lack of smooth pursuit (right eye)
Distinct and sustained nystagmus at maximum deviation (left eye)
Distinct and sustained nystagmus at maximum deviation (right eye)
Onset of nystagmus before 45 degrees (left eye)
Onset of nystagmus before 45 degrees (right eye)
The next test I explained and demonstrated to Wilder was the Walk-and-Turn Test. I asked Wilder if he had any questions. Wilder stated that he did not. I asked Wilder if he understood what I had explained, and he stated that he did. During this test, Wilder showed the following results:
Could not maintain balance while listening to instructions
Started before the instructions were finished
Did not touch heel-to-toe
Lost balance while walking and stepped off the line
Turned incorrectly
Took an incorrect number of steps
The next test I explained and demonstrated to Wilder was the One-Leg Stand Test. I asked Wilder if he had any questions. Wilder stated that he did not. I asked Wilder if he understood what I had explained, and he stated that he did. During this test, Wilder showed the following results:
Swayed while balancing
Put his right foot down
The last test I explained and demonstrated to Wilder was the Field Alco-Sensor Test. The Alco-Sensor is a device approved by the GBI forensics division. Wilder provided a breath sample, and the Alco-Sensor displayed a reading of .179.
The SFSTS were recorded on Officer Cook’s body worn camera.
After completing the SFSTS, I read implied consent to Wilder in English. Wilder did not understand. I then translated implied consent into Spanish. Wilder stated that he was willing to provide a breath sample.
I placed Wilder under arrest for driving under the influence of alcohol. Wilder complied with all of my commands and was placed in handcuffs without incident. I searched Wilder incident to arrest in front of my patrol vehicle. No contraband was found. I then placed Wilder in the back of my patrol vehicle and secured him with a seat belt.
Wilder is a Guatemalan citizen and did not wish for the Guatemalan consulate to be notified of his arrest. Wilder requested that [REDACTED], his sister in law, take possession of his belongings, including the keys to his vehicle, the gray 2001 Nissan Xterra, with tag #[REDACTED BY AGENCY].
I transported Wilder to the Whitfield County Jail. Upon arrival at the jail, I secured my weapon in a lock box at the sally port. I searched the back of my patrol vehicle before and after transport, no contraband was found.
Officer Greer (468) met me at the Whitfield County Jail, where he administered the Intoxilyzer 9000 test to Wilder. Wilder provided a breath sample on the Intoxilyzer 9000, which showed a result of 0.168 grams of alcohol per 210 liters of breath.
Officer Cook informed me that he was able to locate video footage in which the gray Nissan Xterra Wilder was driving can be seen colliding with the mailboxes at [600 BLOCK] 4th ave. Officer Cook will upload the video to this report. Wilder’s vehicle has damage to the front of the vehicle consistent with the incident.
In the video provided by [WITNESS #2], the gray Nissan Xterra can be seen parked by the mailboxes at [600 BLOCK] 4th ave. The vehicle then backs out at a high rate of speed with no regard for its surroundings and stops just before striking a fence. The vehicle then enters the roadway on 4th ave, fails to maintain its lane, and travels on the opposite side of the road. The vehicle then reenters the parking lot through another driveway and continues driving through the parking lot while revving the engine, and accelerating and and braking abruptly several times.
The vehicle then enters a parking space, it backs out at a high rate of speed, brakes abruptly, and then drives forward. The engine can be heard revving, and the tires can be heard squealing. Visible smoke can also be seen coming from the tires. The vehicle then backs out of the parking space at a high rate of speed and brakes abruptly, causing smoke to come from the tires. The vehicle then drives forward around the apartment complex at a high rate of speed and stops by the mailboxes, where it was located upon my arrival.
In the video, a male can be seen exiting the driver’s side of the vehicle. The male appears to be a hispanic male with black hair, wearing a red t shirt and brown pants, which matched Wilder’s appearance and the clothing he was wearing. The male seen exiting the driver’s seat in the video was Wilder.
Wilder was charged on the following citations:
Citation #655147, OCGA 40-6-391(A)(5) – DUI/alcohol .08 grams or more, 21 or over.
Citation #655148, OCGA 40-5-20 – Driving while unlicensed.
Citation #655149, OCGA 40-6-390 – Reckless driving.
Citation #655150, OCGA 40-6-272 – Leaving the scene of an accident.
Citation #655151, OCGA 40-6-48 – Failure to maintain lane.
